Terms of Use – Onyx Executive

These Terms of Use (“Terms”) constitute a legal agreement between Onyx Executive Career Coaching, operating as “Onyx Executive” (“we,” “us,” or “our”) and you (“user” or “you”), governing your use of our website and services. By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access the website or use our services.

1. Services and Payment

1.1 Price and Payment: The price for our services (“the Price”) shall be as quoted on our website and is payable immediately upon placement of an order. Payment may be made by credit card or other cleared funds.
1.2 Services Provided: We will exercise all reasonable skill and care in providing career coaching services, including but not limited to CV writing, career assessments, and interview technique training.

2. Delivery and Risk

2.1 Delivery: We shall deliver completed services to the email address provided by the client. Timeframes for delivery will be agreed upon between Onyx Executive and the client.
2.2 Risk: The use of services provided by Onyx Executive, including CVs and other documents, shall be entirely at the risk of the client following delivery.

3. Limitation of Liability

Onyx Executive accepts no liability for the misuse of services or any loss incurred as a result of such misuse. We do not validate employment details or ensure the accuracy of information provided by the client.

4. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control.

5. General

5.1 Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
5.2 Sub-Licensing: We may sub-license our rights or obligations under these Terms without your consent.
5.3 Headings: Headings in these Terms are for convenience only and shall not affect their interpretation.

6. Entire Agreement

These Terms constitute the entire agreement between you and Onyx Executive regarding the subject matter herein, superseding all prior or contemporaneous agreements, communications, and proposals.

7. Governing Law and Jurisdiction

These Terms shall be governed by the laws of England and Wales, and both parties submit to the exclusive jurisdiction of the courts of England and Wales.

8. Consumer Rights

Nothing in these Terms shall affect the statutory rights of a consumer.
Cancellation and Distance Selling Regulations
Cancellation rights are subject to Distance Selling Regulations. The right to cancel may be waived if the service is commenced immediately upon order placement. Refunds for cancelled services not yet commenced will be issued within 30 days.

9. Scope of Services

Onyx Executive provides career coaching and support services, including CV writing and interview technique training. We are not a recruitment or employment agency and do not offer direct recruitment services.
